In November and December 2020, Fox News aired reports that the US election had been rigged. Fox News specifically credited Smartmatic and Dominion Voting Systems, voting technology and software companies, for their alleged involvement in vote rigging. Both companies have sued Fox for defamation and other claims based on the defendants’ actions. The judges in both cases allowed the complaints, denying the defendants’ motions to dismiss and finding that Smartmatic and Dominion have presented sufficient facts to support their allegations of defamation.

Delaware Superior Court Justice Eric M. Davis ruled in Dominion’s favor that Dominion had shown that the Murdochs, Fox’s top executives, may have been tipped off that the conspiracy theory that rigged voting machines overturned the vote was false , but let Fox News broadcast it anyway. Dominion cited a report in its lawsuit that Rupert Murdoch spoke to Trump “and told him he lost” days after the election, the judge noted.

“These allegations support a reasonable conclusion that Rupert and Lachlan Murdoch either knew Dominion had not rigged the election, or at least recklessly disregarded the truth when they allegedly caused Fox News to broadcast his claims about Dominion,” Davis said.

These lawsuits, seeking billions of dollars in punitive damages and other relief, can deplete Fox’s assets, damage Fox’s reputation and prove detrimental to Fox shareholders.
