AURORA, Colorado — A Denver jury on Nov. 10 awarded more than $2 million in damages to a 24-year-old motorcyclist with injuries sustained in a 2021 crash. Personal injury law firm Franklin D. Azar & Associates represented the plaintiff.

In 2021, the motorcyclist was traveling northbound when a southbound truck made a left turn in front of the cyclist. The motorcyclist collided with the spinning truck, crushing the motorcyclist’s thigh. The defendant’s insurance company argued that the motorcyclist was to blame for the accident because the plaintiff was speeding and did not have a motorcycle license.

“The insurance companies are not intimidating Frank Azar,” said lead attorney Sirchio. “Frank is known for bringing tough cases to court.”

During the trial, Sirchio introduced witnesses to testify about the motorcyclist’s surgeries and recovery and the circumstances of the accident. “We argued that the motorcyclist had the right-of-way and that the defendant was at fault for making the turn when he saw an oncoming motorcycle,” says Sirchio.

Colorado uses a comparative negligence model that allows victims to recover some of the damage they suffered, even if they were partially at fault. The jury also ruled that the motorcyclist was 20 percent at fault for the accident. In this case, the motorcyclist received $2.2 million including interest. The jury returned from deliberation with awards of $500,000 for non-economic damages, $1,000,000 for economic damages and medical bills, and $1,000,000 for impairment.
