Psychedelics Reform Update: 22 States Making Proposals…

In the first months of 2023 at the state level psychedelics Political reforms have been so constant that it is difficult to view them as a passing trend. While the first reported legalization proposal a pre-submitted measure in NY, many states then followed. The list is current as of March 13, 2023.

  • Oklahoma: House has agreed HB 2107 Promote a pilot program to explore the therapeutic potential of psilocybin in certain mental illnesses, while providing legal protections from criminal prosecution for individuals with eligible medical conditions who possess the psychedelic. Clearing the board in a 66-32 vote and following changes to his original versionThe bill will now be submitted to the Senate for consideration.

  • Washington: The Senate approved 41-7 SB5263what after changes -including excluding the actual provision of psilocybin therapy in a controlled setting- would merely create a task force to further research on psilocybin and develop a pathway for legal access to psychedelics. The measure will now face the House of Representatives.

  • Hawaii: The Senate passed the two unanimously supported by the governor Middle SB1454 Creation of a state research task force on psilocybin and SB1531 Established a Beneficial Treatments Advisory Board to study psilocybin and MDMA therapies. Both measures will now face the House of Representatives. Interestingly, the Senate passed the Home Attendance Act HB1340 even with the same vote.

  • Nevada: First read on March 9th SB242 would legalize psychedelic mushrooms and MDMA for research into possible treatments for conditions such as PTSD, depression, anxiety and addiction, and in certain cases would decriminalize up to four ounces of psilocybin mushrooms for adults over the age of 18. The bill was referred to the HHS committee.

  • Texas: Newly filed HB4288 would amend the existing psychedelics law to allow the state to study psilocybin, MDMA and ketamine therapies for military veterans with new research partners and over a longer period of time.
